AMENDMENT No. 1 PROPOSED TO

AMEND on Line 61 by striking the period and inserting in lieu thereof the following:

, within thirty (30) days after a regular general election or ten (10) days after a special election to fill a vacancy.

AMEND FURTHER on Line 63 by inserting after the period the following:

Such procedures and precedents may be found in the Journals of the House of Representatives and of the State Senate and/or in the published Rules of the House of Representatives and of the State Senate.

AMEND FURTHER on Line 66 by inserting after the comma the following:

the Clerk of the House of Representatives, the Secretary of the Senate,

AMEND FURTHER on Line 71 after the period by inserting the following:

In addition, the clerk or the secretary, as the case may be, shall have the authority to enforce any subpoena issued by him or her and to enforce compliance with the time limitations set forth in Section 23-15-955 or in any internal procedure or precedent of the respective house of the state Legislature.

AMEND FURTHER by striking Line 73 in its entirety and by inserting in lieu thereof the following:

AMEND FURTHER on Line 74 by inserting "(1)" after the period on that line.

AMEND FURTHER by inserting between Lines 100 and 101 the following:

(2) The provisions of this section allowing the examination of ballot boxes shall apply in the case of an election contest regarding the seat of a member of the state Legislature. In such a case, the results of the examination shall be reported by the applicable circuit clerk to the Clerk of the House of Representatives or the Secretary of the Senate, as the case may be.

AMEND FURTHER the title by striking all after the semicolon on Line 7 and by striking Lines 8, 9 and 10 in their entirety and by inserting in lieu thereof the following:

TO AMEND SECTION 23-15-911, MISSISSIPPI CODE OF 1972, TO CLARIFY THAT THE PRESENT LAW ON EXAMINATION OF BALLOT BOXES BY CANDIDATES APPLIES IN THE CASE OF AN ELECTION CONTEST REGARDING THE SEAT OF A MEMBER OF THE STATE LEGISLATURE; AND FOR RELATED PURPOSES.
